Objection submission to both DA 571/2016 & Section 96 Modification Application DA 264/2015/B
RE: Objection to Bronte RSL, 113 Macpherson St Bronte – DA 571/2016
The proposed development does not comply with important parts of the WLEP and the WDCP. These variations do not lead to a ‘better outcome’ and have negative effects on the neighbourhood centre and surrounding neighbourhood.
The controls for this site have been determined in detail over the last 4.5 years through due and proper process. Waverley Council, the JRPP and the NSW Department of Planning have consistently endorsed these controls during that time. It follows that the controls must be observed.
There is an approved DA waiting to be built. There is no public benefit in approving this non-complying 2016 DA. It must be refused consent.
I strongly object to the new Bronte RSL DA for the following reasons:
- Too Big – The building is of an inappropriate size and scale. The published FSR is 1.48:1 which is almost 50% above the allowable limit of 1:1.
- Too Tall – The height limit is broken by almost 9m (70%) in the centre of the site and 1.7 m at Chesterfield Lane.
- Too Dangerous
- The proposed commercial space on Chesterfield Lane would lead to commercial trucks and traffic driving through a high child pedestrian area which includes the Clovelly Public School, Clovelly Scout Hall and Bronte Early Education childcare centre.
- Service vehicles for the completed development are not permitted to use Chesterfield Lane under the conditions imposed by the WDAP in the 2015 Bronte RSL DA approval. A commercial space on the lane would lead to this condition being breached.
- The proposed commercial space is an inappropriate use for a narrow residential lane.
- Too Close – the setbacks from surrounding properties do not fit the planning controls. There is not enough deep soil planting area, which is required under the DCP to ensure our suburb has an appropriate amount of green space.
Unacceptable negative impacts of the proposed development include:
- Danger to the high number of children and their families using the ChesterfieldParade/St Thomas St area.
- Loss of visual amenity and of the streetscape character of our neighbourhood dueto excessive visual height and bulk.
- Approval has the potential to lead to further excessively sized developments in theneighbourhood centre which is not appropriate given its location, infrastructure and zoning.
- Increased pressure on already strained local infrastructure, such as parking andpublic transport, which is not sufficient for such a large scale development.
- Loss of privacy and solar access to surrounding residences.
- Increased commercial, service and residential traffic in a narrow rear-access lane designed for low volume residential traffic.
RE: Objection to Bronte RSL, Section 96 Modification Application DA 264/2015/B
I strongly object to the Section 96 application for the approved 2015 Bronte RSL DA
- There should be no changes to the traffic conditions outlined in DA264/2015. The traffic conditions drafted by the Waverley Traffic Committee and put in place by the Waverley Development Assessment Panel were designed to protect the safety of the many children and families walking and playing in the area. They recognise the narrow width of Chesterfield Lane and its unsuitability for commercial trucks and commercial traffic. They recognise the predominately residential nature of the neighourhood.
- No person, traffic engineer or otherwise, should be given authority to overrule the traffic conditions outlined in DA 264/2015 for the reasons listed above.
- There is no need for the rigs and excavation equipment to access the site via Chesterfield Lane and such equipment will have great difficulty negotiating the laneway.
- Such equipment, and any other construction/demolition vehicles or equipment using Chesterfield Parade/Lane would cause damage to the heritage listed Chesterfield Parade Fig trees.
- There should be no loss of parking spaces in Chesterfield Lane.This would have an unnecessary adverse impact on the local residents and members of the school, childcare and scout hall communities.
- There should be no semi-trailers or dog trailers allowed on Macpherson St or surrounding streets as outlined in Condition 32c.
- The noise conditions and prescribed construction hours are not unreasonable and should not be modified as the impact on neighbouring residences will be too great.
The proposed amendments to the approved DA are unnecessary for a successful development and would have unacceptable negative effects on the neighbourhood and on our community. They should be refused and the redevelopment should proceed as permitted in DA 264/2015.
